Search for a Dahlonega real estate attorney and you get directory pages and map pins. This page is the other half: what to check and what to ask, so you can judge any office yourself. We do not name, rank or refer to any firm, and no firm pays to appear here.
Your right to shop
Georgia closings are run by attorneys, but the federal consumer rules still treat closing providers as something you can compare.
What federal law and the CFPB say
- The CFPB notes that closing practices vary by place and that some regions require a title agent, escrow agent or closing attorney at closing, and that buyers can shop for these providers. CFPB blog, 'The essential steps to close on your home with confidence' (page last modified Jun. 25, 2026), checked 2026-10-19
- Federal law (RESPA Section 9) bars a seller from requiring, as a condition of sale, that the buyer purchase title insurance from a particular title company when the buyer uses a federally related mortgage loan. 12 U.S.C. 2608 (RESPA Section 9), via Cornell LII, checked 2026-10-19
- Federal RESPA rules prohibit giving or accepting any fee or thing of value for referring settlement service business on a federally related mortgage loan. CFPB eRegulations, 12 CFR 1024.14 (Regulation X, RESPA Section 8), checked 2026-10-19
- You can usually shop for title insurance separately from your mortgage, and buying both policies from the same provider usually costs less overall. CFPB, Ask CFPB: What is owner's title insurance? (page last modified Aug. 5, 2024), checked 2026-10-19
In practice, your purchase contract and your lender shape who closes your loan. Ask your agent what your contract says about the closing attorney, and ask your lender whether it has to approve the attorney before you commit to one. If anyone suggests an attorney, it is fair to ask whether they receive anything for the suggestion.
Step 1: Confirm the attorney is licensed in Georgia
Only a licensed Georgia attorney may close a Georgia sale for someone else, and Georgia’s good-funds law ties the settlement agent role to active State Bar membership.
Why the license matters
- Under Supreme Court of Georgia rulings, it is the unauthorized practice of law for anyone other than a licensed Georgia attorney to close a real estate transaction for a seller, borrower or lender. Supreme Court of Georgia, In re UPL Advisory Opinion 2003-2, 277 Ga. 472 (2003), opinion text (PDF) hosted by the State Bar of Georgia, checked 2026-10-19
- Georgia's good-funds law defines the 'settlement agent' as the lender or an active member of the State Bar of Georgia responsible for conducting the settlement and paying out the proceeds. O.C.G.A. 44-14-13 (2025 Georgia Code), via Justia, checked 2026-10-19
Look the attorney up on the State Bar of Georgia website and check that the listing shows an active member. A firm name on a sign is not enough; the attorney who will control your closing is the one to check.
Step 2: Ask whom they represent
In a typical financed purchase, the closing attorney is often engaged on the lender’s behalf. Ask the attorney at the start whom they represent. If you want your own lawyer, you can hire one.
The same firm says buyers are not required to have their own attorney, and that a buyer who wants personal representation will likely pay separately for it. (Stewart, Melvin & Frost (Gainesville, Ga. law firm), 'Real Estate – What is the role of a closing attorney' (page modified 2022-11-03), checked 2026-10-19)
Sellers should ask the same question. If the closing attorney is working for the lender and the buyer, a seller with a title issue, an estate sale or an out-of-state move may want separate advice from a Georgia attorney.
Step 3: Get a written, itemized quote
No official source publishes a typical attorney fee for Georgia or Dahlonega, so we do not print one. Compare quotes by their lines, not by a single total. Questions to send each office:
- Whom will you represent in my closing?
- Which charges are your own fees, and which are passed through to others, such as title insurance premiums, state taxes and recording?
- Does the quote include the lender’s title policy, an owner’s title policy, or both?
- Which forms of payment do you accept for funds to close, and how will you give me wiring instructions?
- What phone number should I use to confirm wiring instructions before I send money?
- Who will be at the signing, and can any part of the closing be done by video?
- Will I see the settlement statement before closing day, and how early?
- If someone signs by power of attorney, or for an LLC or trust, what do you need and how far ahead?
- When will the deed be recorded, and how will I get a copy?
- Is there anything about this property’s title you expect to need extra time for?
Then line the quotes up in the closing-cost estimator, which computes Georgia’s taxes for you and takes every other figure from your own quotes. What each attorney and title fee line means.
Step 4: Check the money instructions before you rely on them
Whoever you choose, confirm payment details by phone using a number you found yourself.
Before you send money
- The CFPB advises writing down contact information for two trusted people, such as your real estate and settlement agents, who can confirm payment details. CFPB, 'Buying a home? Beware of mortgage closing scams' one-page handout (PDF), checked 2026-10-19
- The CFPB says not to use phone numbers or links from an email, and to confirm with your trusted contacts using only the numbers you saved. CFPB, 'Buying a home? Beware of mortgage closing scams' one-page handout (PDF), checked 2026-10-19
Wire fraud and good funds has the full routine.
Questions this page cannot answer
Which firm is best, whether your contract protects you, and anything about divorce, an estate dispute, a specific title defect or taxes. Those belong to a Georgia attorney you hire, or a tax professional. Who answers which closing question.
Questions buyers ask
How do I find a real estate attorney in Dahlonega?
Compare more than one. The CFPB notes that buyers can shop for closing providers such as closing attorneys. Check each attorney’s State Bar of Georgia listing and ask for a written, itemized quote.
Can the seller make me use their title company?
Not as a condition of the sale when you use a federally related mortgage loan. RESPA Section 9 bars a seller from requiring the buyer to buy title insurance from a particular title company.
Can someone be paid for referring me to a closing attorney?
Federal RESPA rules prohibit giving or accepting any fee or thing of value for referring settlement service business on a federally related mortgage loan.
