The State of Georgia

Collects the transfer tax on the deed and the intangible tax on a new security deed.

Georgia's real estate transfer tax is $1.00 for the first $1,000 of value and 10 cents for each additional $100 or fraction of $100, on deeds transferring realty sold for more than $100.

What will your Georgia closing cost?

Georgia sets three charges by law on a home sale: the transfer tax on the deed, the intangible recording tax on a new mortgage, and the clerk’s recording fee. This sheet computes them from the statute rates below. Every other line is a number you copy from your own Loan Estimate or written quotes.

The recording trail

From signed contract to recorded deed

Six steps every Georgia closing passes through. Your contract sets the dates; the law sets a few rules along the way.

What the closing attorney does
  1. Binding agreement

Both sides sign the purchase contract. It sets the due diligence period, the closing date and who pays what.

  2. Attorney engaged, title searched

A licensed Georgia attorney conducts the closing and reviews the title.

Under Supreme Court of Georgia rulings, it is the unauthorized practice of law for anyone other than a licensed Georgia attorney to close a real estate transaction for a seller, borrower or lender. Supreme Court of Georgia, In re UPL Advisory Opinion 2003-2, 277 Ga. 472 (2003), opinion text (PDF) hosted by the State Bar of Georgia

  3. Loan approved, disclosure sent

The lender sends the Closing Disclosure before you can sign.

Your lender must give you the Closing Disclosure at least three business days before you close on the mortgage loan. CFPB, Ask CFPB: What is a Closing Disclosure? (page last modified Sept. 6, 2024)

  4. Funds by verified wire

The attorney pays out only collected funds. Confirm any wiring instructions by phone first.

Under Georgia's good-funds law, a settlement agent generally may not pay out closing proceeds unless the money is 'collected funds' in the agent's escrow account. O.C.G.A. 44-14-13 (2025 Georgia Code), via Justia

  5. Signing and disbursement

Documents are signed and the settlement agent pays out the proceeds.

Georgia's good-funds law defines the 'settlement agent' as the lender or an active member of the State Bar of Georgia responsible for conducting the settlement and paying out the proceeds. O.C.G.A. 44-14-13 (2025 Georgia Code), via Justia

  6. Deed recorded

The deed and security deed go on record with the Lumpkin County Clerk of Superior Court.

Decision tool 2

Put your closing dates on one calendar

Type the dates from your purchase contract. The planner lays out the deadlines between signing and recording, counts the federal Closing Disclosure deadline the way the rule counts business days, and lets you add every date to your calendar.

How are you paying?

  1. Your contract date

    Binding agreement

The contract is accepted. Your deadlines run from here, counted the way your contract says.

  2. Binding date + your due diligence days

    Due diligence period ends

Inspections, survey questions and insurance quotes belong before this date. Check your contract for the exact end time.

  3. After the attorney is engaged

    Title search and commitment

The closing attorney’s office reviews the county records for the property and tells you what must be cleared before closing.

Supreme Court of Georgia, In re UPL Advisory Opinion 2003-2, 277 Ga. 472 (2003), opinion text (PDF) hosted by the State Bar of Georgia, checked 2026-10-19

  4. 3 business days before closing

    Closing Disclosure in your hands

Your lender must get the Closing Disclosure to you at least three business days before you sign. Compare it with your Loan Estimate.

CFPB, Ask CFPB: What is a Closing Disclosure? (page last modified Sept. 6, 2024), checked 2026-10-19

  5. Before you send any money

    Confirm wiring instructions by phone

Call the closing attorney’s office at a number you looked up yourself, never one from an email, before you wire funds.

CFPB, 'Buying a home? Beware of mortgage closing scams' one-page handout (PDF), checked 2026-10-19

  6. Your closing date

    Closing

Documents are signed, funds are disbursed by the closing attorney, and the keys change hands as your contract provides.

  7. After closing

    Deed recorded in Lumpkin County

The deed and any security deed are recorded with the Lumpkin County Clerk of Superior Court, custodian of the county’s land records.

  8. April 1 after you move in, per the county flyer; confirm with the county

Homestead filing reminder (county flyer date)

You qualify for a tax year if you own the home and live in it as your legal residence on January 1. Lumpkin County’s tax flyer lists April 1 as its filing date. State law now also allows filing through the 45-day appeal window on your assessment notice. Confirm your own deadline with the Lumpkin County Tax Commissioner or Assessor.

A planning aid, not legal advice. Your contract sets your deadlines and how its days are counted; your closing attorney and lender confirm the schedule. Business days here skip Sundays and federal legal holidays, as the Closing Disclosure rule does.

Questions

What Dahlonega buyers and sellers ask about closing

Short answers, each with the law or office behind it.

Is Georgia a closing attorney state?

Yes. Under Supreme Court of Georgia rulings, closing a real estate transaction for a seller, borrower or lender is the practice of law, so only a licensed Georgia attorney may do it.

Source: Supreme Court of Georgia, In re UPL Advisory Opinion 2003-2, 277 Ga. 472 (2003), opinion text (PDF) hosted by the State Bar of Georgia

Can you close on a house in Georgia without an attorney?

Georgia’s attorney-closing rule does not stop you from handling, on your own behalf, a transaction you are a party to. Anyone who closes the sale for someone else must be a licensed Georgia attorney.

Source: Supreme Court of Georgia, In re UPL Advisory Opinion 2003-2, 277 Ga. 472 (2003), opinion text (PDF) hosted by the State Bar of Georgia

Who does the closing attorney represent?

In a typical financed purchase, the closing attorney is often engaged on the lender’s behalf. Ask the attorney at the start whom they represent. If you want your own lawyer, you can hire one. One Northeast Georgia law firm describes the closing attorney’s primary function as representing the lender and overseeing the transaction.

How much does a closing attorney cost in Dahlonega?

No official source publishes a typical Georgia or Dahlonega closing attorney fee, so we do not print one. The CFPB notes that buyers can shop for closing providers. Ask each attorney’s office for a written, itemized quote.

Does everyone have to be in the same room for a Georgia closing?

Not necessarily. A 2025 State Bar of Georgia formal advisory opinion says a lawyer can conduct a real estate closing by video conference, as long as the lawyer controls the closing process from beginning to end. Your closing attorney and lender decide whether yours can be done that way.
